The Supreme Court on Saturday directed Punjab Police to register a case, as directed by a sessions court, against all nominated involved in alleged torture of Ayesha Ahad Malik, the woman who claims to be spouse of former Punjab chief minister’s son Hamza Shehbaz, and her daughter Mah-e-Noor.
A two-member apex court bench headed by Chief Justice of Pakistan and comprising Justice Ijazul Ahsan observed that if the order had not been set aside by a higher court then the case should be lodged immediately. The bench also ordered Punjab Police Inspector General Arif Nawaz to provide security to the complainant.
As the hearing went underway, the chief justice directed Punjab Advocate General Asma Hamid to ensure appearance of Hamza before the court by 1pm. The CJP also asked health minister Khawaja Salman Rafiq, who was present before court for another case, about the whereabouts of Hamza to which he replied in the negative. The advocate general told the court that Hamza was out of country and would return within three to four days.
The bench also directed the inspector general to submit a record of cases registered against Ayesha and sought details of police officials who had refused to initiate a case against the respondents.
Later, hearing of the case was adjourned until June 29.
The CJP had taken a suo motu notice on a complaint of Ayesha, daughter of former Pakistan Muslim League-Quaid (PML-Q) MPA and film producer Ahad Malik, who had approached the country’s top judge complaining about delay in registration of case on the trial court’s order.
In her complaint, Ayesha had stated that a sessions court in 2011 had ordered the police to lodge a case against Hamza Shehbaz, Ali Imran, son-in-law of ex-chief minister Shehbaz Sharif, former Punjab law minister Rana Sanaullah, former Sindh IG Rana Maqbool, former additional inspector general (investigation) Zulfiqar Cheema and others. However, the case could not be registered.
Ayesha along with his daughter was arrested in 2011 on charges of kidnapping their Filipino maid’s son and receiving Rs 2.2 million as ransom following registration of a case against under section 506 PPC. Later, anti-terrorism provisions were added to the case.
The same year, an anti-terrorism court allowed police ten-day physical remand of Ayesha but the Lahore High Court on Ayesha’s petition on October 7, 2011 suspended the same and also questioned the integrity of the trial judge. The LHC had also ordered an inquiry against the judge for granting remand without “applying judicial mind”.
At that time, Ayesha moved a petition before a sessions court for registration of a case against police officials for keeping her and her daughter in illegal custody and also subjecting them to torture. She had held Hamza Shehbaz, Rana Sanaullah Khan, Ali Imran and some other police officers responsible for lodging a fake case against the both.
